Bergland said that Ernest Hancock of ALP has said that he intends, upon receiving the voter registration list, to post the entire list on the Internet for public use. He said that Hancock had sent him a copy of the AZ statute. He said that his reading of the statute is that Hancock would not be violating the statute if he were to do so.
He lied to get lots of publicity and said he was going to get arrested by taking his gun into the Department of Revenue with out checking it. But in the end it was all a lie just to get publicity. He didn’t get arrested as he said he would. He wasted a lot of people time. And he lost credibility with a lot of people.

SHOWDOWN at the Tax Collector
Libertarian Activist, Ernie Hancock has notified AZDOR and Capitol Police that he will be there at the AZDOR building on Wednesday at noon-30 to check his firearm or be arrested. This will give him standing to sue the crap out of Revenue Director Mark Killian, the State of Arizona, and the poor cop who is ordered by his superior to falsely arrest Ernie. Why is Hancock getting involved now? His wife went to pay their business sales taxes last week. She asked to check her gun at the security station as allowed by law as was her habit. The security guard said, "I can't check it like I did before because I got in trouble." Ernie Hancock later told DOR attorney Bill Inman, "This used to be just theoretical politics to me. But now it's my family. It's my wife."
Mark Killian just screwed up big time.
We have invited the press, politicians, candidates, and lots of self defense activists. This will be a turning point. We will soon see if Second Amendment-supporting politicians can walk the walk as they talk the talk. Will they show? Will we vote for them and volunteer for their campaigns? The ball is in their court.
A message from Ernest Hancock
Saturday, June 29th 2002. Please set that afternoon aside for a statewide invitational gun activist meeting being sponsored by S.A.F.E. (Second Amendment is For Everyone). The location for the event will be announced as soon as arrangements have been finalized. Please read this post for information on events that will lead up to this meeting and the political and legal ramifications for this election cycle as well as others in the future.

The scheduled arrest will be Wed. May 8th at the Arizona Department of Revenue 1600 W. Monroe at 12:00 noon. There will be a small gathering after which at 12:30pm I am to be arrested.

A. A person commits misconduct involving weapons by knowingly:
10. Unless specifically authorized by law, entering any public establishment or attending any public event and
carrying a deadly weapon on his person after a reasonable request by the operator of the establishment or
the sponsor of the event or the sponsor's agent to remove his weapon and place it in the custody of the
operator of the establishment or the sponsor of the event;
My insistence on having the state abide by the clear language of Arizona Law is now far more a political question than a legal one. Those who are close to me know that my activism has been a personal quest for more freedom for myself and my family. The entertainment provided to others and the increased awareness of various issues has been a beneficial side effect for those who believe as I do.
Many have helped in this effort and have done a great deal to encourage me. Some have even offered to be arrested with me. I thank you all.
This message is to clarify my intentions and my hopes for the future, as well as to offer a solution for our continual problems with a government that has little respect for the law and would have us jailed for insisting that they do.
The dissection of each word in the aforementioned law could turn it's meaning into jibberish in the hands of a government prosecutor and this is what I must be prepared for. But this battle will be won in the hearts and minds of the people, not the courtroom. Rights not exercised tend to evaporate so I plan on taking mine out for a little walk.
The political ramifications are the greatest. History has shown that the attitude that governments, or their administrators, have for the people that they exist to serve is often best demonstrated by their willingness to allow the people the ability to defend themselves with arms. Arizona's heritage is one of freedom and self-reliance that is the result of a pioneering spirit that doesn't have to go back too many generations to find its roots. But what makes Arizona so special and alluring to many is the spirit of freedom enjoyed here - compared to the home states of many where the government has invaded every aspect of daily life to an intolerable degree.
Why is it always guns? I have to give credit to my friend L. Neil Smith whom I quote here since he has been able to explain this far better than I.

"Over the past 30 years, I've been paid to write almost two million words, every one of which, sooner or later, came back to the issue of guns and gun-ownership. Naturally, I've thought about the issue a lot, and it has always determined the way I vote.

What I've chosen, in a world where there's never enough time and energy, is to focus on the one political issue which most clearly and unmistakably demonstrates what any politician -- or political philosophy – is made of, right down to the creamy liquid center.
"Make no mistake: all politicians -- even those ostensibly on the side of guns and gun ownership -- hate the issue and anyone, like me, who insists on bringing it up. "If he doesn't want you to have the means of defending your life, do you want him in a position to control it?
"If he makes excuses about obeying a law he's sworn to uphold and defend -- the highest law of the land, the Bill of Rights -- do you want to entrust him with anything?
"If he ignores you, sneers at you, complains about you, or defames you, if he calls you names only he thinks are evil – like "Constitutionalist" -- when you insist that he account for himself, hasn't he betrayed his oath, isn't he unfit to hold office, and doesn't he really belong in jail?
"Sure, these are all leading questions. They're the questions that led me to the issue of guns and gun ownership as the clearest and most unmistakable demonstration of what any given politician -- or political philosophy -- is really made of.
"He may lecture you about the dangerous weirdoes out there who shouldn't have a gun -- but what does that have to do with you? Why in the name of John Moses Browning should you be made to suffer for the misdeeds of others? Didn't you lay aside the infantile notion of group punishment when you left public school -- or the military? Isn't it an essentially European notion, anyway -- Prussian, maybe -- and certainly not what America was supposed to be all about?
"And if there are dangerous weirdoes out there, does it make sense to deprive you of the means of protecting yourself from them? Forget about those other people, those dangerous weirdoes, this is about you, and it has been, all along.
"Try it yourself: if a politician won't trust you, why should you trust him? If he's a man -- and you're not -- what does his lack of trust tell you about his real attitude toward women? If "he" happens to be a woman, what makes her so perverse that she's eager to render her fellow women helpless on the mean and seedy streets her policies helped create? Should you believe her when she says she wants to help you by imposing some infantile group health care program on you at the point of the kind of gun she doesn't want you to have?
"On the other hand -- or the other party -- should you believe anything politicians say who claim they stand for freedom, but drag their feet and make excuses about repealing limits on your right to own and carry weapons? What does this tell you about their real motives?
"Makes voting simpler, doesn't it? You don't have to study every issue -- health care, international trade -- all you have to do is use this X-ray machine, this Vulcan mind-meld, to get beyond their empty words and find out how politicians really feel. About you. And that, of course, is why they hate it.

So here in Arizona we have an election with many candidates to choose from. Which ones of them have demonstrated their ability to uphold their oath to the highest law of the land?
The NRA definitely _does not represent me_. It is nothing more than the political lap dogs of the Republican party and has helped to draft many of the gun control laws we now suffer under. They promise their repeal if only gun owners will send them money and support the candidates that they give a favorable rating to. Jon Kyl's vote for the 1994 Crime Bill that outlawed many firearms was rewarded with an A+ rating by the NRA. They are much worse than useless in the opinion of many.
Even in years they've controlled the Arizona House and Senate, as well as the Executive branch, Republicans have passed more gun control and there is no end in sight for still more restrictions.
The opportunity is here,... now - for elected officials and their challengers to support the simplest concept idea that the government should abide by its own laws. I don't expect a show of support from legislators and candidates. In fact, I expect my point to be made quite clearly by their absence. I can't count the number of times that I've been told by a candidate or elected official how much they support the 2nd Amendment. But what does that mean?
Even the most anti-gun, anti-freedom politician should be expected to take the position that a department of the government should obey the law.
Saturday, June 29th, I am encouraging gun rights activist to participate in an effort to deprive undeserving candidates of all parties the votes and support of those who wish to make their votes really count. The votes that are taken for granted by so many Republicans are to be either withheld entirely or used in support of one of their own. The election laws and recent court decisions have made every political party in the state of Arizona an entity of the state. The state determines the locations of party conventions, the internal structure of the parties, forces them to accept subsidies from the taxpayers in order to exist and allows over 350,000 non-members a vote to determine the standard bearers for the party's philosophy. With a membership of less than 20,000, the Libertarian Party is all but a memory.
But, the Libertarian Party has ballot access for its members. The elections laws are such that only 1-5 petition signatures are required to have your name placed on the primary election ballot. But wait,... it gets better. As late as August 27th you can register your name as an official write-in candidate for the Libertarian primary election. If you get the same number of write-in votes that were required for the petition method your name will appear on the General Election ballot.
I am no longer an officer of the Libertarian Party and offer this option as a suggestion from someone who knows the law and gun owners' options. I encourage all supporters of the Right to Keep and Bear Arms to leave open the date of June 29th for a presentation of each of the legislative districts new boundaries - who the candidates are - what their records are - what their actions/inactions have been - and which are to be targeted. This will be a single issue campaign,... the issue is freedom.
